When in the Course of human events it becomes necessary for one people to dissolve the political bands which have connected them with another and to assume among the several States, the separate and equal station to which the United States Constitution, Laws of Nature and of Nature’s God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

New Yorkers still hold these truths to be self-evident, that everyone is created equal, that they are endowed by their Creator with certain unalienable Rights that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, state governments are instituted among citizens, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends and no longer represents the interest of the majority, it is the Right of the People to separate themselves from it, alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness. Prudence, indeed, will dictate that state Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn that mankind are more disposed to suffer, while evils are sufferable than to right themselves by dividing themselves from the state government, however oppressive, to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such state government, and to provide new Guards for their future security. — Such has been the patient sufferance of the New York upstate counties and such is now the necessity which constrains them to separate themselves from the current state government. The history of the present and past governors of New York State is a history of repeated injuries and usurpations at the expense of the upstate citizenry, all having in direct object the establishment of an absolute Tyranny over the counties of upstate New York. To prove this, let Facts be submitted to a candid world.

Taxation without Representation. Upstate counties have effectively no voice in the state government. The proportion of legislators from New York City compared to upstate counties respectively means that upstate counties have no effective representation in the current state government in Albany which only represents the interest of New York City and its surrounding counties.

New York State has the highest overall taxes of all the fifty states in America. High taxes are a consistent symptom of tyranny  and oppressive governments funding as they do overreaching state agencies and policies at the expense of the liberty of its citizens. The high taxation in New York, administered upon its citizens with no recourse, directly steal from the current prosperity of its citizens and of future generations.

Highest property tax. New York ranks only behind New Jersey in highest property taxes in the United States. New York has the highest taxes placed on apartment buildings which are then passed to the renters, causing the unduly high financial burden on renters in New York.

Loss of jobs. Due to the ineffective and unfair policies of the state government of New York, upstate counties are unduly suffering in job growth, unemployment and underemployment. All citizens have been forced to pay for the statist policies of the state government while money is spent and nearly all jobs are created in the southern counties at the expense of the upstate counties. New York has lost hundreds of thousands of high paying jobs with just a marginal amount of those being replaced and all of those being with lower-paying service sector jobs. In addition, New York State is more than $353 Billion in debt which the citizens of the upstate counties will be equally required to pay, but without receiving the same representation in the state government nor the equal distribution in state spending.

State Education / Common Core Standards. New York State’s citizens pay the most of any state in America for education but consistently ranks in the bottom half of all states in student success.  New York imposes the dysfunctional Common Core standards and judges teacher and student performance solely on standardized tests which force the teachers to no longer teach, but only to prepare the students for such test. This shortchanges the entire state of New York, financially burdens the citizens for substandard performance at an extortionate cost.

Refusal to Equitably Distribute Emergency Funding. The safety and security of its citizens is the most important task of any government. New York State has a disregard for the preparedness of the counties in the event of a crisis, in flagrant violation of its own state law. New York collects over $182 million annually in 911 funding which is directed to the state general fund and not to public safety. Instead the state forces the counties to compete against each other to improve public safety and emergency preparedness and even then only 25% of all this funding is available to the upstate counties. The Southern counties are exempted from this competition and receive a disproportionate amount of this funding.

Unfunded Mandates Imposed on the Counties. The government of New York has imposed more than forty unfunded mandates upon the subordinate governments of the counties, causing an unfair and undue financial and administrative burden for which the unrepresented counties have no representative redress.

Loss of Representation in Washington. The federal and national elected representatives to the Congress of the United States do not reflect nor represent the values, ideology nor support the national legislative agenda of the Upstate Counties. The Southern Counties hold such a disproportionate power over the people of the Upstate Counties deems it unlikely that the National government will never represent the citizens and will of the people of Upstate New York. In addition, due to the number of citizens fleeing unjust policies of the state government of New York, the state has lost representation in the House of Representatives, diminishing the value and voice of the citizens of the Upstate counties. The policy and statute of New York which awards the total of all votes of the Electoral College in presidential elections results in the votes and will of the citizens of the upstate counties are discarded when choosing the President of the United States.

Ignoring the Bill of Rights and the Constitutional freedoms of the people. Acts and Statutes passed in disregard to the will of the citizens of the upstate counties as the New York SAFE Act are unconstitutional and ignore the freedoms and liberty afforded and guaranteed to the people of New York by the United States Constitution and the Bill of Rights. The citizens of the upstate counties are unable to acquire redress or relief from such unjust laws due to the nature and ideology of the courts in support of the tyrannical government of New York State.

Difference in Ideology. The government and governor of New York State have consistently demonstrated a divergent and opposing ideology of the majority of the citizens of the upstate counties and do not defend the very principles of Life, Liberty and the Pursuit of Happiness.  The policies reflecting this opposing ideology are reflected in statutes and regulations on life, family, protecting our children in schools, protecting our lives and property, preserving the sanctity of our votes and ensuring the integrity of our elections, diminishing the value of our very citizenship and in a myriad of other ways which directly affect our daily lives, raising our children and the election of our representatives. The tyrant of New York has even dictated that those citizens of this state whose ideologies differ from his own have no place in this state.

Lowest personal freedom. Due to all of the above collectively, New York State consistently has the lowest personal freedom ranking of all fifty states of the Union. The good citizens of the upstate counties are victims of the policies and taxation to support the Southern New York counties each of which destroy our Liberty and Freedoms.

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms and have spoken in our elections in a valid and fair attempt to redress this unfair situation: Our repeated actions, votes and petitions have been answered only by repeated injury. A state government, whose character is thus marked by every act which may define a tyrannical, is unfit to be the ruler of a free people, which the people of the upstate counties are free no longer.

By all objective quantitative measures, New York State is the worst state in the country with the good citizens of the upstate counties remaining effectively unrepresented and unfairly required to fund.

We, therefore, the Representatives of the resolved Upstate Counties of New York, appealing to the People and Citizens of New York, and to the Congress of the United States for the rectitude of our intentions, do, in the Name, and by Authority of the good People of these Upstate counties, solemnly publish and declare, That these united Counties of Right ought to be a Free and Independent State, that they should be Absolved from all Allegiance to the existing government of New York State in Albany, and that all political connection between them and the State of New York, ought to be totally dissolved; and that as Free and Independent Regions of the following upstate counties, they have full Power to do all Acts and Things which any Independent State of the United States may of right do under the Constitution of the United States and under its own and new Constitution:

  1. A) The New York Region shall consist of the counties Bronx, Kings, New York,

Queens and Richmond.

  1. B) The New Amsterdam Region shall consist of the counties of Albany, Allegany,

Broome, Cattaraugus, Cayuga, Chautauqua, Chemung, Chenango, Clinton,

Columbia, Cortland, Delaware, Dutchess, Erie, Essex, Franklin, Fulton, Genesee,

Greene, Hamilton, Herkimer, Jefferson, Lewis, Livingston, Madison, Monroe,

Montgomery, Niagara, Oneida, Onondaga, Ontario, Orange, Orleans, Oswego,

Otsego, Putnam, Rensselaer, Saratoga, Schenectady, Schoharie, Schuyler,

Seneca, St Lawrence, Steuben, Sullivan, Tioga, Tompkins, Ulster, Warren,

Washington, Wayne, Wyoming, and Yates.

  1. C) The Montauk Region shall consist of the counties of Nassau, Suffolk,

Rockland, and Westchester.

It is Common Sense for the counties of Upstate New York to separate from the government in Albany that is owned and controlled by New York City and the adjoining counties. This won’t be an easy movement to accomplish its goals. It will take concerted effort on the part of the citizens of New York counties who will directly benefit with freedom and liberty as originally intended by our Founders and Framers.

The last legal and peaceful avenue to secure the liberties and freedoms for those in the upstate counties is through a New York Constitutional Convention. This next general election, November 7th a referendum is proposed to the voters.  The delegates to the NY Constitutional Convention will be appointed by the counties, not the state. These delegates then can amend the NY State Constitution to begin the process to making this independence happen. Vote YES on holding a NY Constitutional Convention.

This cause is worthy. Our intentions just.  And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our Lives, our Fortunes, and our sacred Honor.
